Image Use Request
To request permission to use images from the Kona Historical Society’s archive collection, read the Conditions and Policies for Use and fill out the form below. Please include as much information as possible to avoid delays in processing your application. See the list of Image Reproduction and Use Fees. Conditions and Policies for Use
Photographic prints are supplied by the Kona Historical Society for research use only. Special written permission must be secured prior to use for any type of reproduction.
When permission is granted, a fee will be assessed for each print to be used. Use fees are per photograph and do not include processing costs. Permission authorizes non-exclusive one-time, one-edition reproduction use only, and can be used only for the purposes stated. Any subsequent or different use must be applied for in writing. An additional use fee may be assessed.
Proper credit must be given to the photographer, if known, and to the Kona Historical Society. The basic credit line is: From the Collections of the Kona Historical Society. The credit line must appear immediately beneath the photograph if used in a publication.
Kona Historical Society gives no exclusive rights to any publisher, author, or photographer and assumes no responsibility for duplication of images by others and no responsibility for claims by third parties.
Applicant assumes all responsibility for questions and/or potential claims regarding any copyright, trademark, invasion of privacy, or other intellectual property rights claim that may arise from the copying and/or use of Kona Historical Society materials.
The publisher/applicant shall furnish the KHS with a complimentary copy of any work in which the photographs appear.
Any alteration, such as color tinting or retouching, is not allowed.
I agree to pay in advance the assessed permission/use charges for my use of any images provided.
NOTICE: WARNING CONCERNING COPYRIGHT RESTRICTIONS
The copyright law of the United States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be “used for any purpose other than private study, scholarship, or research.” If a user makes a request for, or later uses, a photocopy or reproduction for purpose in excess of “fair use,” that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of the copyright law.
